1. Duration of Rental Period: Duration of rental period is from the time the renter takes delivery of Spa and any other equipment or assessories until the spa and any other equipment or assessories are picked up by Quick Spa LLC. 2. Quick Spa LLC agrees to rent to Renter and Renter agrees to rent from Quick Spa LLC, that may include all or some of the following items: 1. X-400 Hot Tub at a rate of $225.00 per 24Hrs 2. Set of Steps $25.00 Per Rental Period 3. Privacy Screens $75.00 Per Rental Period 4. Floating Candles $20.00 Per Set of 6 5. Towels $20.00 Per Set of 4 6. 8’x 8’ Platform $40.00 Per Rental Period 7. Extension Cord $10.00 Per Rental Period 8. X-400 Cover Included in X-400 Rental 3. Payment: Payment may be made by Cash, Check, or Credit. Credit will only be made through paypal. Payment will consist of rental fees of spa and other equipment and assessories and Security Deposit. Before Delivery of spa a $500.00 Security Deposit will be made to Quick Spa LLC and will be refunded within 14 days after the Pick up date of the Spa. Refund of Security Deposit will be 100% if all equipment, assessories and spa are returned without damage (refer to Clause 5)and in its delivery condition. 4. Condition of Property Renter acknowledges receiving the property in good condition. If there is any damage or anything wrong with the spa, equipment or assessories, the renter MUST notify Quick Spa LLC immediately otherwise renter will be held liable for any damages incurred. 5. Damage or Loss Renter will return the property to Owner in good condition except as noted in Clause 4. If the property is damaged while in renter’s possession, Renter will be responsible for the cost of repair, up to the current value of the property. Owner reserves the right to apply cleaning fees as Owner determines necessary. If the property is lost while in Renter’s possession, Renter will pay Owner its current value. Important Safety Instructions and Precautions To reduce the risk of injury, do not permit children to use this product unless they are closely supervised at all times. To reduce the risk of electrical shock, install at least 5 feet from all metal surfaces. Do not permit any electric appliance, such as light, telephone, radio, or television, within 5 feet of spa. The water in a spa should never exceed 104 degrees F. Water temperatures between 100-104 degrees are considered safe for a healthy adult. Lower water temperatures are recommended for your children and when spa use exceeds 10 minutes. Hot water can raise the body temperature high enough to cause heat stroke. Since excessive water temperatures have potential for fetal damage during the early months of pregnancy, pregnant or possibly pregnant women should limit spa water temperatures to 100 degrees. The use of alcohol, drugs, or medication before or during spa use may lead to unconsciousness with the possibility of drowning. Despite the popular image of people in spas drinking wine or other alcoholic beverages, DO NOT use alcoholic beverages before or during spa use. Alcohol is a depressant, which causes slowed reflexes and drowsiness, especially in conjunction with the relaxed soaking in hot water. Using your spa with other people who are also drinking is not a preventative measure since they are likely to become similarly affected by the combinations of alcohol and hot water soaking. Always use care in and around your spa. The spa has many rigid, unyielding parts and many areas that become wet and slippery, these are all potentially dangerous when rough play is permitted or if care is not used particularly when entering or leaving the spa. Soaking in hot water causes changes in the circulatory system, such as enlargement of blood vessels near the skin. Therefore, people with a medical history of heart disease, circulatory problems, diabetes, or high blood pressure should check with their physician before using spas. Additionally, people taking medications causing drowsiness, such as tranquilizers, narcotics, antihistamines, or anticoagulants should not use spas without asking their physician. Prolonged immersion in hot water may induce hyperthermia. Hyperthermia occurs when internal body temperature reaches a level of several degrees above the normal body temperature of 98.6 degrees. The symptoms of hyperthermia include (1) dizziness, (2) fainting, (3) drowsiness, (4) lethargy; (5) increases in the internal body temperature. The effects of hyperthermia include: (1) unawareness of impending hazard, (2) failure to perceive heat, (3) failure to recognize the need to exit spa, (4) physical inability to exit spa, (5) unconsciousness resulting in danger of drowning. Accidents can occur when long hair or a body part is trapped by suction from a drain or outlet whose cover is broken or removed. Children are particularly vulnerable, and they should be warned against danger.
Rentals may be applied to new equipment purchases under the following terms and conditions. A. 90% of the rental fee will be applied to new equipment purchases for orders received during the rental term. B. 40% of the rental fee will be applied to new equipment purchases for orders received within 30 days of the end of the rental term. C. 15% of the rental fee will be applied to new equipment purchases for orders received 31-60 days after the end of the rental term. D. None of the rental fee will be applied to equipment purchases for orders received after 60 days following the end of the rental term. E. The equipment being purchased must be of the same model as the equipment being rented. Title to the equipment is, and at all times shall remain, in the Owner, Renter will not permit the equipment to be used at any other address other than the place designated without the express consent of the Owner. Renter shall be solely responsible for and shall indemnify, defend and hold Owner harmless against all claims, suits, damages or losses. Specifically including the loss of use of property, and all other liabilities whatsoever. Including related expenses and attorney’s fees, for or on account of injuries to or death of any person, including but not limited to the property of the Renter or Owner, occasioned by the operation, handling or transportation of the equipment is in the possession or control of the Renter. Notwithstanding the foregoing, Renter shall have no indemnity obligations whatsoever to the extent any such claims, suits, damages, losses or other liabilities are caused, directly or indirectly, by the negligence of the Owner. Renter will not retain any equipment beyond its return date without prior notice to and consent of the Owner. Renter agrees to pay all collection charges, including reasonable attorney’s fees, if rental is not paid when due. Owner, at Owner’s sole discretion, may report equipment stolen if held 5 days beyond return date. Conditions, which prevent satisfactory operation of equipment, do not relieve Renter of his or her responsibility for rental charges. Owner is not responsible and no adjustments will be made for weather conditions, or your ability to correctly operate the equipment.
